Galoob Wins Judgement Over Nintendo

Lewis Galoob Toys Inc. said a three-dudge panel of the U.S. Ninth Circuit
Court of Appeals has unamiously affirmed a lower court's decision to award
Galoob a $15-million judgment in its legal battle with Nintendo of America
Inc. over Galoob's Game Genis video-game enhancer.

Lewis Galoob Toys said the court confirmed Galoob's right to receive $15
million as compensation for lost profits while it was enjoined from
selling Game Genie for the 8-bit Nintendo Entertainment System from June
1990 to July 1991.

"If Nintendo chooses to continue appealing this matter, they still have
additional procedural steps available to them," says William G. Catron,
Galoob's executive vice president, general counsel and chief
administrative officer.

Nintendo had sued Galoob claiming Game Genie violated its copyrighted
games. In a statement released February, the company said it is "very
disappointed by the decision of the Ninth Circuit Court and believes it is
profoundly wrong."

It added that the "court's determination that the Galoob Game Genie, which
alters Nintendo's video games, did not infringe Nintendo's copyrights in
those games strips all owners of audio-visual works of a major aspect of
copyright protection."
