 AB    In Italy 35% of all prisoners (today more than 50,000) are I.V.D.A.
       About 60% of them should be (the test is not compulsory) HIV positive.
       Recently (1993, July) Italian Legislators issued a law that provides the
       immediate release from prison for all HIV+ prisoners presenting CD4
       cells count < 100. We think that this law is a populist and talsely
       guaranted measure. As provided in WHO Guidelines on HIV Infection and
       AIDS in prison. All prisoners have the right to receive health care,
       including preventive measures, equivalent to that available in the
       community, without discrimination. We hold up as an example four
       prisoners, released from Pavia(3) and Voghera(1) penitentiaries between
       1993 July and 1994 February. These inmates were completely asymptomatic,
       HIV+, and their CD4 were < 100. Three subjects were hospitalized within
       36 hours after the release, for heroin overdose; the fourth, an out and
       out thief was oriented three other times for theft and immediately
       released. Health care is not the release from prison! If a killer of
       mafia, camorra ..... should be HIV+ with CD4 < 100, he must be
       immediately released from prison. In our country, with this absurd law,
       neither patients can receive appropiate health care, neither community
       can live without anxiety.
